Terms and Conditions of Entry – Nick Jr. Presents Yo Gabba Gabba! COOL TRICKS at Myer Competition
General
(a) Nickelodeon Australia Management Pty Ltd ACN 627 643 021 of 5 Thomas Holt Drive, North Ryde, NSW 2113, Australia (Nickelodeon) is the promoter and conducts competitions from time to time, which eligible people may enter.
(b) This Competition Nick Jr. Presents Yo Gabba Gabba! COOL TRICKS at Myer Competition.
(c) Information on how to enter forms part of these Competition Terms and Conditions.
(d) By entering this Competition you agree to these Competition Terms and Conditions.
Entry requirements
(a) Entry is open to any legal parent or guardian of a child between 3 and 12 years of age as at 6th April 2009 on behalf of the child
(b) The competition commences from 9:00am on Monday 16th March, 2009 and entries close at 11:59pm on Wednesday 8th April, 2009. Entries received after the closing date will not be eligible.
(c) Due to the age of the entrants, Nickelodeon may, at its discretion, award any prize to a child’s parent or legal guardian
(d) The employees, agents and contractors of Nickelodeon, any of its affiliate, parent or subsidiary companies are not eligible to enter the Competition.
(e) Direct family members of any person included in 2(c) are not eligible to enter.
(f) The Competition can be entered in the following manner:
Online
To enter, entrants must log onto the Nick Jr. website (www.nickjr.com.au) and fill out information form and register. 2) If the entrant has previously registered their details they are only required to enter their NickName and Password in order to enter the competition.
Entrants are required to film a short clip of their child performing their own cool trick. Entrants need to download the clip to the Nick Jr. website, as well as their kids’ name and details. Entrants are also required to nominate the city in which they will be able to attend the finals and the live show.
Post
The entrants must send an envelope, containing their videos or DVDs as well as contact information to:

Clips must not exceed 2 minutes.
(g) Any person who fails to provide the information requested as part of an entry process will not be eligible for any Competition prize.
(f) Any information, photographs, audio-visual or other material provided to Nickelodeon by an entrant as part on an entry to the Competition will not be returned to entrants. Entrants are advised to not send original material.
(g) There is a limit of 1 entry per child
(h) Nickelodeon will not be liable to any entrant in any way, if for reasons beyond Nickelodeon’s reasonable control including without limitation any failure of technology, the competition is cancelled or suspended or Nickelodeon fails to receive any entry.
(i) Nickelodeon accepts no responsibility for lost entries.
(j) Unless otherwise agreed, any personal or confidential information submitted to Nickelodeon by any person in the course of entering or being otherwise involved in this Competition such as name, address, telephone number will be treated in accordance with Nickelodeon’s Privacy Policy. Entrants’ details will be added to the Nickelodeon Australia Database.
Judging
(a) The Competition will be judged on Thursday 9th April
(b) The competition is a game of skill
(c) The judging will be held at Nickelodeon offices – 5 Thomas Holt Drive, North Ryde NSW 2113.
(d) The 180 Cool Tricks judged the most creative will be invited to attend the Nick Jr. Presents Yo Gabba Gabba! COOL TRICKS at Myer final events in selected Myer stores in their nominated city.
(e) The parent or Legal guardian of the children chosen will be notified by telephone according to the details provided at the time of entry. All reasonable efforts will be made to contact the winners.
(f) From the 180 finalists, 6 winners will be chosen from each city to attend the Live show in their chosen city
(g) The decision of the judges is final and Nickelodeon will not enter into correspondence or communication regarding the judges’ decisions even where Nickelodeon may not have acted reasonably or where Nickelodeon is shown to have made a decision in error.
Prizes
6 major winners from each city (18 in total) who will receive the following:
• One family pass (2 adults and two children under the age of 12) to the Nick Jr. Presents Yo Gabba Gabba! Live on Stage event in their nearest city (valued at $170.00)
• The winner will perform their Cool trick at Nick Jr. Presents Yo Gabba Gabba! Live on Stage (money can’t buy)
• The winner will also meet DJ Lance Rock (money can’t buy)
• 1 x Yo Gabba Gabba! Prize Pack (valued at $200.00)
The total value for each Major prize is $370.00
252 Finalists will receive a Yo Gabba Gabba! Prize Pack (valued at $24.95)
The total prize pool for this competition is $12,947.40
(b) As prize winners will be under the age of 18 they must be accompanied by a parent or guardian when collecting any prize. Due to the nature of the prizes all prizes must be accepted personally by prize winners. If a prize winner is unable to accept a prize personally Nickelodeon reserves the right to award that prize to a alternate entrant with no obligation or liability to the replaced prize winner.
(c) If any prize requires shipment to the prize winner Nickelodeon will pay the costs of such shipment to the prize winner’s usual residential address within Australia. Nickelodeon will not be responsible for insuring any prize during shipment or for any loss or damage to the prize during shipment.
(d) Nickelodeon may require any person collecting or receiving a prize to show photograph identification and/or sign a deed declaring that they have collected or received the prize before Nickelodeon gives the prize over.
(e) Nickelodeon may require any person collecting a prize to sign a copy of the Competition Terms and Conditions.
(f) Once a prize has been collected Nickelodeon is not responsible for the use or distribution of any prize.
(g) Nickelodeon may decline to award a prize if in its reasonable opinion a prize winner is prevented by law from receiving the prize, awarding the prize to the prize winner may be unsafe, would contravene any law, regulation, code of practice or the prize winner has not complied with these terms and conditions.
(h) Nickelodeon will not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for personal injury suffered or sustained, as a result of taking and/or using any prize under this Competition.
(i) Travel and accommodation costs are not included in this competition
(j) Nickelodeon will not be liable to any prize winner and a prize winner will have no right, title and interest in any prize, and must return or refund any prize awarded if the prize winner is found to be ineligible to enter this Competition or if Nickelodeon awards a prize in error.
(k) If a prize referred to in this Competition becomes unavailable for any reason Nickelodeon reserves the right to substitute that prize for an item of similar value.
(l) Prizes are not transferable or redeemable for cash. Nickelodeon accepts no responsibility for any variation in the value of the prizes.
(m) Prize winners agree to participate in any promotional activity promoting Nickelodeon, prize sponsors and/or the Competition at the reasonable request of Nickelodeon.
Intellectual Property
(a) Nickelodeon may record, reproduce, publish, adapt, communicate or otherwise use the entrants’ and/or prize winners’ performances, names, voices, and likeness for the purposes of creating or producing any television program or other audio and/or audio-visual material and for advertising and publicity purposes in any media in perpetuity without needing to provide additional compensation.
(b) Any material, including without limitation Competition entries and images and/or audio-visual material included in Competition entries, submitted or provided by a Competition entrant, and/or prize winner in association with any Competition will become the property of Nickelodeon and Nickelodeon may reproduce, publish, adapt, communicate, cause to be seen and/or heard in public or otherwise use any such material throughout the world in perpetuity and without needing to provide additional compensation.
(c) Nickelodeon may require an entrant or prize winner to execute any document necessary to give effect to 5(a) and/or (b).
Warranties
(a) Nickelodeon may require any prize winner to warrant and represent in writing to Nickelodeon that they:
(i) have not been charged or convicted of any criminal offence in Australia or any other jurisdiction;
(ii) have not been involved in any activity that if made publicly known is likely to bring Nickelodeon into disrepute; and
(iii) will not involve themselves in any activity that may in the future bring Nickelodeon into disrepute.
(b) Entrants warrant and represent to Nickelodeon that nothing in any entry to any Competition infringes the rights, including copyright, of any third party and is not defamatory or obscene and does not breach any state or commonwealth law.
(c) Entrants indemnify Nickelodeon against any claim, loss or damager suffered by Nickelodeon as a direct or indirect consequence of a breach by the entrant of any warranty or representation contained in these Competition Terms and Conditions.
(d) If Nickelodeon becomes aware that a prize winner is in breach of any warranty contained in these Competition Terms and Conditions or made subsequently to Nickelodeon, Nickelodeon may deem that prize winner ineligible.
Governing Law
These Terms and Conditions are to be construed according to the laws New South Wales, Australia and are subject to the non-exclusive jurisdiction of the courts of that state.
